Welcome to Neel Ayurvedics. These Terms and Conditions ("Terms") govern your access to and use of the website operated by Neel Ayurvedics Private Limited ("Neel Ayurvedics", "we", "us" or "our"), including the purchase of products through our website.
By accessing, browsing or using our website, creating an account, placing an order or purchasing any product through our website, you acknowledge that you have read, understood and agreed to these Terms, together with our Privacy Policy, Shipping Policy, Return/Refund Policy and other applicable policies displayed on our website.
If you do not agree with these Terms, please do not use the website or place an order.
1. Eligibility
1.1 You must be at least 18 years of age to place an order through our website.
1.2 By using our website or placing an order, you represent that the information provided by you is true, accurate, complete and current.
1.3 If you are placing an order on behalf of a business, organisation or another person, you represent that you are authorised to do so.
2. Products and Product Information
2.1 We make reasonable efforts to ensure that product names, descriptions, images, prices, specifications, ingredients, pack sizes and other information displayed on our website are accurate and up to date.
2.2 Product images are provided for identification and representation purposes. Actual packaging, colour, label design, batch number or appearance may vary from the images displayed on the website due to manufacturer changes, packaging updates or batch variations.
2.3 Products may be manufactured or supplied by different manufacturers, brands, authorised distributors or suppliers. Unless expressly stated otherwise, Neel Ayurvedics is a retailer/trader and is not the manufacturer of third-party branded products.
2.4 Product information supplied by manufacturers, brands and distributors may change from time to time. We may update product information where reasonably necessary.
2.5 Nothing on the website shall be interpreted as medical advice, diagnosis or treatment advice. Customers should consult a qualified healthcare professional where appropriate, particularly in relation to medicines, pregnancy, existing medical conditions, allergies or use of products alongside prescription medicines.
3. Product Availability and Procurement
3.1 Products displayed on our website are subject to availability.
3.2 Our website may display products that are not physically stocked at our warehouse at the time an order is placed. Depending on the product, demand and inventory requirements, we may procure products from manufacturers, authorised distributors or suppliers after receiving an order.
3.3 We may use such procurement arrangements particularly for products with irregular demand, limited availability, high value, shorter shelf life, specialised formulations, classical Ayurvedic preparations, mineral-based preparations, gold-containing preparations, imported products or products for which manufacturer/distributor prices fluctuate materially.
3.4 Procuring products closer to the date of dispatch may enable us, where reasonably practicable, to supply a comparatively current/recently available batch and avoid unnecessary long-term inventory holding.
3.5 Procurement from a manufacturer, distributor or supplier after receipt of an order does not constitute a guarantee that the product will always be available at the price displayed on the website at the time of placing the order.
4. Prices and Pricing Changes
4.1 Prices displayed on the website are intended to represent the applicable selling price at the time of listing or updating, subject to the provisions of these Terms and applicable law.
4.2 Prices may change from time to time due to changes in manufacturer or distributor prices, taxes, duties, freight, exchange rates, import costs, procurement costs, availability, batch-specific pricing, market conditions or other commercial factors.
4.3 Certain products, including high-value, specialised, rare, classical, mineral-based, gold-containing, imported or limited-availability products, may be subject to additional price and availability verification before final order confirmation.
4.4 Where the current procurement price of a product has materially changed after an order has been received but before final order confirmation or dispatch, we may contact the customer and communicate the applicable revised price.
4.5 The customer may then:
(a) accept the revised price and pay the difference, where applicable; or
(b) decline the revised price, in which case the affected product/order may be cancelled and the amount paid for the affected product/order will be refunded in accordance with our Refund Policy and applicable law.
4.6 We will not knowingly charge an additional amount without informing the customer of the revised price and obtaining the customer's acceptance.
4.7 Nothing in these Terms is intended to permit deliberate or misleading price advertising or to exclude any mandatory consumer rights available under applicable law.
5. Order Placement, Payment and Acceptance
5.1 When you place an order through our website, you are submitting a request to purchase the selected products at the price and on the terms displayed at that time.
5.2 An automated order acknowledgement, payment acknowledgement, email, SMS, WhatsApp message or website status such as "Order Received", "Payment Received", "Processing" or "Order Placed" confirms receipt of the order/payment but does not necessarily constitute final acceptance of the order.
5.3 For products requiring price, availability, batch or procurement verification, the order will remain subject to verification before final confirmation and dispatch.
5.4 Where applicable, "Final Order Confirmation" means confirmation issued by Neel Ayurvedics after completing the applicable price, availability and procurement verification.
5.5 We may contact the customer before final confirmation if:
the product is unavailable;
the product is unavailable at the displayed procurement cost;
the manufacturer/distributor has materially changed its price;
the product or required quantity cannot reasonably be procured;
there is a material pricing, inventory, technical or listing error;
the product has an unsuitable available batch or shelf-life condition; or
another circumstance prevents us from reasonably fulfilling the order as placed.
5.6 If the order cannot be fulfilled at the displayed price, the customer may be offered the option to accept the applicable revised price or cancel the affected order/product and receive a refund.
6. Pricing, Technical and Listing Errors
6.1 We take reasonable steps to maintain accurate pricing, inventory and product information. However, inadvertent technical, typographical, data-entry, synchronisation, inventory or pricing errors may occasionally occur.
6.2 If a material error is identified before final order confirmation or dispatch, we may contact the customer and explain the applicable correction.
6.3 The customer may choose to proceed at the corrected applicable price or cancel the affected product/order and receive a refund of the amount paid for the affected product/order.
6.4 We will not use this provision as a means of deliberately advertising products at an artificially low price or inducing customers to place orders.
7. Batch, Manufacturing Date and Shelf Life
7.1 Ayurvedic, herbal, food, wellness and other products may be supplied from different manufacturing batches depending on availability from manufacturers and distributors.
7.2 Consequently, the manufacturing date, batch number, packaging and expiry/best-before date may vary between orders.
7.3 Where reasonably practicable, we endeavour to procure products with an appropriate and reasonably substantial portion of their stated shelf life remaining.
7.4 However, unless a specific minimum remaining shelf life is expressly stated on the relevant product page or separately agreed with the customer in writing, we do not guarantee a particular manufacturing date, batch number or minimum remaining shelf life.
7.5 Products will not knowingly be dispatched by us after their applicable expiry date.
7.6 If a particular available batch does not meet our applicable procurement or quality requirements, we may attempt to procure another suitable batch, offer an alternative where appropriate, or cancel and refund the affected order/product.
7.7 Customers should inspect the product, batch information and expiry/best-before information upon receipt and follow the manufacturer's instructions for storage and use.
8. High-Value and Specialised Ayurvedic Products
8.1 Certain Ayurvedic products may contain precious, mineral, metal-derived or other specialised ingredients and may be subject to significant changes in manufacturer/distributor pricing and availability.
8.2 Such products may therefore require additional verification of current price, stock, batch and availability before final confirmation.
8.3 Where the applicable procurement price has materially changed, the procedure specified under Section 4 of these Terms shall apply.
9. Payment
9.1 Payment may be made through the payment methods made available on our website.
9.2 Payment received against an order does not prevent us from carrying out the verification process described in these Terms.
9.3 Where an order is cancelled by us because the product cannot reasonably be supplied, the displayed price cannot be honoured following the applicable verification process, or the customer declines a revised price, the amount received for the affected order/product will be refunded in accordance with the applicable Refund Policy and payment-processing timelines.
9.4 Payment gateway, banking or third-party processing timelines may affect the time taken for a refund to appear in the customer's account.
10. Cancellation by Customer
10.1 Customers may request cancellation of an order before dispatch, subject to the applicable Cancellation and Refund Policy and the nature of the product.
10.2 Once an order has been dispatched, cancellation may no longer be possible and the applicable Return/Refund Policy shall apply.
10.3 Certain products may not be eligible for return or cancellation where permitted by applicable law, including products affected by hygiene, safety, contamination, tampering or other applicable restrictions.
10.4 Nothing in these Terms excludes or restricts any mandatory consumer rights available under applicable law.
11. Cancellation by Neel Ayurvedics
11.1 We may cancel an order or an affected product where reasonably necessary due to:
non-availability;
inability to procure the product;
material change in procurement price where the customer does not accept the revised price;
material pricing or technical error;
inability to obtain a suitable batch;
suspected fraudulent or unauthorised transaction;
incorrect or incomplete customer information;
legal or regulatory restrictions;
force majeure; or
any other circumstance making fulfilment commercially or legally impracticable.
11.2 Where payment has already been received for a cancelled order/product, the applicable amount will be refunded in accordance with our Refund Policy and applicable law.
11.3 Where only part of an order is affected, we may cancel and refund the affected product while processing the remaining products, subject to customer communication where reasonably practicable.
12. Delivery and Shipping
12.1 Delivery timelines displayed on the website are estimates unless expressly stated otherwise.
12.2 Delivery may be affected by courier delays, weather, strikes, customs clearance, government restrictions, incorrect addresses, customer unavailability, force majeure or other circumstances beyond our reasonable control.
12.3 Customers are responsible for providing accurate delivery information, including name, address, postal code, telephone number and other required information.
12.4 For international orders, the customer is responsible for complying with applicable import requirements of the destination country to the extent legally applicable to the customer.

13. Returns, Refunds and Defective Products

13.4 We may request photographs, videos, batch details, invoice information or other reasonable evidence to investigate a product-related complaint.
